Role of AK Tourfinders

• AK Tourfinders offers a purely technological platform that facilitates the connection between prospective tourists with operators to hire an entire vehicle. It doesn’t operate any vehicle or offer the service of transportation to the User. Rather than, these reservations are fulfilled by operators that have an empaneled relationship with AK Tourfinders.

• The information supplied or updated by the vehicle operator is the only basis on which AK Tourfinders makes the vehicle booking voucher that it gives to a User. 

• The relevant vehicle operator provides the amenities, services, rates, routes schedule, kind of car/tempo, and any other information related to the car/tempo service; AK Tourfinders has no authority over the information provided by the car/tempo operator or the fulfillment of the same.

Limitation Of Liability of AK Tourfinders

• As a technological platform that makes transactions between users and car/tempo operators easier. AK Tourfinders shall not be liable in any way for any failure on the part of a service provider to supply the user with a specific car or climate, for any inadequate level of service or other service-related problems, including but not limited to the following:

• Timely departure or arrival of the vehicle;

• The conduct of car/tempo operator's employees, representatives or agents;

• The condition of the vehicle, seats etc. not being up to the customer's expectation or as per the description provided by the bus operator;

• Loss or damage of the baggage of the customer;

• Car/tempo operator using a separate pick-up vehicle to transport the User from the designated boarding point to the actual place of departure of the car/tempo.

• In certain cities, the name of the operator with whom the customer is booking may be displayed. In these situations, every attempt will be made to guarantee that the reservation is fulfilled by the same operator. In other cities, AK Tourfinders will select an operator from its panel to complete the booking, while the client is simply shown the vehicle type. 

• If the rental car is unavailable or breaks down while traveling, AK Tourfinders will get in touch with the relevant service provider to arrange for a replacement vehicle of the same or better quality. If the user needs any help, they can contact digital97influencer@gmail.com.

• The vehicle operator is solely responsible for securing all necessary licenses, permits, and other authorizations in order to carry out the scheduled travel. AK Tourfinders shall not be held responsible in any way for any booking cancelation caused by the vehicle operator's lack of required licenses or permits. 

Responsibilities of The Users

• Users are advised to call the vehicle operator to find out the exact boarding point, or any information which they may need for the purpose of boarding or travel in that trip

• At the time of boarding the car/tempo Users shall furnish a copy of the confirmation booking voucher, and any valid identity proof issued by a government authority.

Cancellation policy is as follows

• Cancel before 7 days from the trip start date and a 100% refund of advance booking amount is applicable.

• Any cancellations between 2-7 days before the start of the trip date, cancellation charges of 50% of the Total Pricing amount will be applicable.

• Any cancellation made within 24 hours of the trip date, cancellation charges of 100% of the Total Pricing amount will be applicable.

• Refunds will be processed within 7 working days after the cancellation request is made.

• Postponement, of tour for any reason whatsoever, will be treated as cancellation on that tour and a fresh booking of a new tour. Thus, cancellation charges would apply for the same.

Payment for booking and any additional charges

• Full Payment: AK Tourfinders may receive payment in full at the time of booking. The basic fare, any applicable taxes, including GST, that may be imposed in accordance with local legislation, and any additional booking fees, service fees, or convenience fees levied by AK Tourfinders are all included in the total booking amount. 

• Partial Payment: With this option, the user must pay a portion of the total amount due at the time of booking and the remaining amount within the time frame chosen at that same time. The booking will be canceled if the remaining balance is not paid within the allotted time, and any return will be governed by the booking/cancellation policy. The client could sometimes be allowed to pay the remaining amount at the beginning of the trip. 

• Pay At Car/Tempo: In respect of this option, the User must pay AK Tourfinders a portion of the booking amount that is stated at the time of booking, and the remaining payment to the vehicle operator at the beginning of the trip. 

• Expenses like toll charges, permit charges, parking charges, entry fees, Service Tax & any other Government Tax as per Government guidelines are to be borne by the User and paid directly to the driver, wherever applicable.

• The excess Driver Bata wherever applicable has to be paid directly to the driver.

Role of AK Tourfinders and limitation of liability

• The only thing that AK Tourfinders can do is help the User purchase an activity service from the relevant activity provider. The User and the Activity Provider are the parties involved in the transaction or service fulfillment relationship at all times. 

• AK Tourfinders shall not provide pick up and drop facility for any Activity unless otherwise explicitly mentioned in the confirmation of the reservation.

• AK Tourfinders shall not be liable or responsible for:

• Any damage or loss, injury, accident, death, breakdown, irregularity, delay/change in schedule, cancellation without cause, inaccurate information, deficiency of service/product, or cancellation due to conditions not under the control of Activity Provider;

• The health, safety and well-being of the User in the course of availing the Activity or thereafter;

• Any incidental or ancillary services which is directly purchased by the User from the Activity Provider;

• Any incorrect information provided by the Activity Provider.

• The maximum liability of AK Tourfinders will be limited to refund of booking amount which was received by AK Tourfinders for reservation of the Activity.

Responsibilities of the users

• The User agrees to comply with the terms and conditions of Activity Provider in addition to AK Tourfinders' Terms of Service.

• The User shall further be in possession of valid documents viz. identity proof, address proof or any other document as specified by the Activity Provider in order to utilize the Activity booked.

• The User may be required to sign a waiver/consent form, safety procedure form, medical declaration or other document before availing the Activity where mandated by the Activity Provider.

• The User shall reach out to Activity Provider directly for any concerns subsequent to the confirmation of reservation.

• The User should ensure that he qualifies all the eligibility criteria for availing the Activity including but not limited to age limit, weight limit, medical conditions etc. User understands that in case he is found unfit or illegible for the Activity, Activity provider may or may not allow the User to avail the said Activity.

Special offers and coupons

The following terms will additionally apply to any coupon provided by AK Tourfinders: AK Tourfinders’s responsibility is limited to sharing the coupon with the User subject to receipt of payment from the User;

• The redemption of the coupon is User’s responsibility, and providing the service will be the Activity Provider’s responsibility;

• The expiry date of the coupon shall be mentioned on the coupon and the User will not be able the use the coupon subsequent to the date of expiry;

• The coupon is not redeemable for cash;

• The coupon once purchased cannot be refunded or cancelled.

User’s responsibility

All laws, including but not limited to the Motor Vehicle Act rules, applicable regulations, recommendations, or directions passed or issued by the Central Government or relevant State Governments, must be complied with by the car/tempo operator alone. The car/tempo operator will be responsible for paying any fines or penalties that may result from breaking any of these laws, rules, regulations, or guidelines, including any fare control directives from the relevant RTOs. The user consents to file any complaints with the car/tempo operator on any cancellations or service deficiencies brought forth by enforcement agencies.
